General Terms and Conditions (GTC) for Jasmin Peters’ Online Coaching

1. General

1.1 These General Terms and Conditions (GTC) apply to all contracts between Jasmin Peters, Ehrenbergstraße 59, 22767 Hamburg (hereinafter referred to as “Coach”), and her clients in the field of online coaching.

2. Subject matter of the contract

2.1 Jasmin Peters offers online coaching services in the field of personality development.

2.2 The services are usually provided via Zoom or in person at Ehrenbergstraße 59, 22767 Hamburg.

3. Conclusion of contract

3.1 Registration for the coaching services takes place via the jasminpeters.de website.

3.2 By registering and booking the service, the customer declares his binding offer to conclude a contract. The contract is only concluded after confirmation by Jasmin Peters.

4. Payment methods

4.1 The prices for the coaching services are exclusive of VAT due to the small business regulation in accordance with § 19 of the German VAT Act.

4.2 Payment is made by credit card, PayPal, Apple Pay, Google Pay or Klarna in the Online Shop and must be made before invoicing. After payment, the customer will automatically receive an invoice by email. Alternatively, it is also possible to purchase on account, the invoice amount can then be paid by bank transfer or in cash.

4.3 A customer account is created in which appointments can be booked and orders can be viewed.

5. Right of withdrawal

5.1 Customers have the right to withdraw from the contract within 14 days without giving reasons.

5.2 In order to exercise the right of withdrawal, the customer must inform Jasmin Peters of the decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail).

6. Obligations of the Parties

6.1 Jasmin Peters undertakes to provide the coaching services to the best of her knowledge and belief.

6.2 The Client undertakes to arrive on time for the agreed coaching sessions and to actively participate in the sessions.

7. Liability

7.1 Jasmin Peters is only liable for damages that are based on an intentional or grossly negligent breach of duty.

7.2 Jasmin Peters is only liable for damage caused by slight negligence in the event of a breach of a material contractual obligation, the fulfilment of which is essential for the proper execution of the contract and on the compliance with which the customer may regularly rely.

8. Data protection

8.1 Jasmin Peters collects, processes and uses personal data of the client exclusively for the purpose of carrying out the coaching services.

8.2 The data will be treated confidentially and will not be passed on to third parties, unless there is a legal obligation.

9. Termination and Term

9.1 The contract is concluded for the duration of the booked coaching service and ends automatically with the provision of the last agreed service.

9.2 Either party may terminate the contract at any time for good cause without notice. Good cause exists in particular if one of the parties violates essential contractual obligations.

10. Cancellation
10.1 A cancellation of an agreed appointment must be made at least 2 hours before the start of the appointment.

10.2 If the cancellation is made later or not at all, a cancellation fee of €50 must be paid.

11. Final Provisions
11.1 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

11.2 The place of jurisdiction for all disputes arising from this contract is the registered office of Jasmin Peters, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.

11.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
